Spousal Support Overview

Spousal support is a monetary payment that is made by one spouse to another spouse in the event of a divorce or a legal separation.  These payments are also commonly referred to as alimony.  In cases where spousal support is an issue, spouses will either have to agree upon the amount and duration of the payments or they will have to have the family law courts intervene.  When the courts intervene, a judge will review each spouse’s:  employment status, income, health status, educational background and ability to earn income.  A judge will also give close consideration to the length of the marriage and the role each spouse played throughout the marriage.  For example, if one spouse stayed at home, ran the household and took care of the couple’s children, a judge will take note of this and award spousal support to that spouse. 

Judges will also reward spousal support payments in cases where one spouse is considered “dependent” and the other spouse is considered “independent”.  A spouse will usually be categorized as “dependant” if he/she is not capable of obtaining employment, has poor health or has become accustomed to a certain quality of life.  Once rewarded, spousal support payments are usually made on a monthly basis to the dependent spouse for a set period of time, as alimony can be awarded on a temporary or permanent basis.
